Health Rights is a multidisciplinary collection of seminal papers examining ethical, legal, and empirical questions regarding the human right to health or health care. The volume discusses what obligations health rights entail for governments and other actors; how they relate to and potentially conflict with other rights and values; and how cultural diversity bears on the formulation and implementation of health rights.

Strategies to increase influenza vaccination rates have typically targeted healthcare professionals and individuals in various high-risk groups such as the elderly. We argue that they should focus on increasing vaccination rates in children. Because children suffer higher influenza incidence rates than any other demographic group, and are major drivers of seasonal influenza epidemics, we argue that influenza vaccination strategies that serve to increase uptake rates in children are likely to be more effective in reducing influenza-related morbidity and mortality than those (...) targeting HCPs or the elderly. This is true even though influenza-related morbidity and mortality amongst children are low, except in the very young. Further, we argue that there are no decisive reasons to suppose that children-focused strategies are less ethically acceptable than elderly or HCP-focused strategies. (shrink)

. Recent corporate scandals have focused the attention of a broad set of constituencies on reforming corporate governance. Boards of directors play a leading role in corporate governance and any significant reforms must encompass their role. To date, most reform proposals have targeted the legal, rather than the ethical obligations of directors. Legal reforms without proper attention to ethical obligations will likely prove ineffectual. The ethical role of directors is critical. Directors have overall responsibility for the ethics and compliance programs (...) of the corporation. The tone at the top that they set by example and action is central to the overall ethical environment of their firms. This role is reinforced by their legal responsibilities to provide oversight of the financial performance of the firm. Underlying this analysis is the critical assumption that ethical behavior, especially on the part of corporate leaders, leads to the best long-term interests of the corporation. We describe key components of a framework for a code of ethics for corporate boards and individual directors. The proposed code framework is based on six universal core ethical values: (1) honesty; (2) integrity; (3) loyalty; (4) responsibility; (5) fairness; and (6) citizenship. The paper concludes by suggesting critical issues that need to be dealt with in firm-based codes of ethics for directors. (shrink)

This paper describes the application of eight statistical and machine-learning methods to derive computer models for predicting mortality of hospital patients with pneumonia from their findings at initial presentation. The eight models were each constructed based on 9847 patient cases and they were each evaluated on 4352 additional cases. The primary evaluation metric was the error in predicted survival as a function of the fraction of patients predicted to survive. This metric is useful in assessing a model’s potential to assist (...) a clinician in deciding whether to treat a given patient in the hospital or at home. We examined the error rates of the models when predicting that a given fraction of patients will survive. We examined survival fractions between 0.1 and 0.6. Over this range, each model’s predictive error rate was within 1% of the error rate of every other model. When predicting that approximately 30°K of the patients will survive, all the models have an error rate of less than 1.5%. The models are distinguished more by the number of variables and parameters that they contain than by their error rates; these differences suggest which models may be the most amenable to future implementation as paper-based guidelines. Many believe that the ethical problems of donation after cardiocirculatory death (DCD) have been "worked out" and that it is unclear why DCD should be resisted. In this paper we will argue that DCD donors may not yet be dead, and therefore that organ donation during DCD may violate the dead donor rule. We first present a description of the process of DCD and the standard ethical rationale for the practice. We then present our concerns with DCD, including the following: (...) irreversibility of absent circulation has not occurred and the many attempts to claim it has have all failed; conflicts of interest at all steps in the DCD process, including the decision to withdraw life support before DCD, are simply unavoidable; potentially harmful premortem interventions to preserve organ utility are not justifiable, even with the help of the principle of double effect; claims that DCD conforms with the intent of the law and current accepted medical standards are misleading and inaccurate; and consensus statements by respected medical groups do not change these arguments due to their low quality including being plagued by conflict of interest. Moreover, some arguments in favor of DCD, while likely true, are "straw-man arguments," such as the great benefit of organ donation. The truth is that honesty and trustworthiness require that we face these problems instead of avoiding them. We believe that DCD is not ethically allowable because it abandons the dead donor rule, has unavoidable conflicts of interests, and implements premortem interventions which can hasten death. These important points have not been, but need to be fully disclosed to the public and incorporated into fully informed consent. These are tall orders, and require open public debate. Until this debate occurs, we call for a moratorium on the practice of DCD. (shrink)

Merrimack, N.H.: Thomas More College Press, 2021. xxv + 549 pp. Cloth, $65.00The profound influence that Pseudo-Dionysius had on Aquinas’s thought, (...) especially in his metaphysics of participation and his apophatic theology, has been known for some time now, thanks to the excellent work of such scholars as Fran O’Rourke. One would therefore think that Aquinas’s Exposition of the Divine Names (his only commentary on the works of Pseudo-Dionysius) would have been translated a lot sooner. This delay is assuredly due not just to the difficulty of translating this work but also to a certain embarrassment felt by Thomists over Aquinas’s sincere belief that the “Dionysius” who wrote the Divine Names was the Areopagite whose conversion at the teaching of St. Paul is mentioned in the Acts of the Apostles. That the author calling himself “Dionysius” was in fact a theologian writing in the fifth or sixth centuries has been well established by modern scholarship. Hence, Thomists may have felt tempted to discount or at least pass over the influence of this author on Aquinas since it is discomfiting to think that the Church’s greatest theologian accorded such authority to an imposter.Michael Augros tackles these concerns head-on in the excellent introduction to his new translation of the Divine Names commentary. First, Augros points out that in past centuries a pseudonym was usually not an act of forgery but, rather, a way of concealing the author’s identity, which an early Christian theologian might well decide to do either out of humility or out of a desire “to avoid provoking certain prejudices” in those who disagreed with him in contemporary theological disputes. Moreover, it is likely that the work was never intended for the general public (who could easily mistake the pseudonym as genuine) but, rather, was written for those “already initiated in a particular Neoplatonic school of Christian theology,” who would recognize the author as being “one of their own” but without knowing his precise identity. Finally, in taking the particular name of “Dionysius,” the author of the Divine Names was indicating his intention for the work: Just as the biblical Dionysius was a Greek philosopher who converted to Christianity, so the works of Pseudo-Dionysius [End Page 345] are an attempt to reconcile Greek philosophy with the Christian faith.It therefore seems likely, as Augros observes, that Aquinas would still have accorded a great deal of respect to the Divine Names even if he had learned the truth of the author’s identity. The work would not have had the same deuterocanonical authority for him that comes with being written by a direct disciple of St. Paul himself, but “the inherent cogency, coherence, and beauty” of Pseudo-Dionysius’s theology would have been the same. Hence, Pseudo-Dionysius would surely have earned from Aquinas the “docile attitude” appropriate “for a philosopher and theologian of the first order, such as Boethius.”That Aquinas was right to see the author of the Divine Names as a master philosopher and theologian becomes evident when one dives into the text itself, in which Aquinas sees a truly dazzling order, both externally and internally. According to Aquinas, the Divine Names discusses those truths about God of which there are intelligible likenesses in creatures, such as goodness or wisdom, whereas the truths about God of which there are sensible likenesses (for example, “when God is called a lion, or a rock”) are treated by Pseudo-Dionysius in The Symbolic Theology; meanwhile, in the lost or fictional work The Divine Characteristics, Dionysius claims to have treated those truths about God (such as the Trinity) that cannot be known through any likenesses in creatures.Aquinas finds a still more intricate order within the Divine Names itself. Although several theories of online syntactic processing assume the parallel activation of multiple syntactic representations, evidence supporting simultaneous activation has been inconclusive. Here, the continuous and non‐ballistic properties of computer mouse movements are exploited, by recording their streaming x, y coordinates to procure evidence regarding parallel versus serial processing. Participants heard structurally ambiguous sentences while viewing scenes with properties either supporting or not supporting the difficult modifier interpretation. The curvatures of the elicited trajectories revealed both an effect of visual context (...) and graded competition between simultaneously active syntactic representations. The results are discussed in the context of 3 major groups of theories within the domain of sentence processing. (shrink)

This paper argues that an expansion of this proposal—whereby provision of already existing medicines are incentivised in a similar way—would provide a more comprehensive solution to the healthcare situation in developing countries. It then considers the practical challenges that the implementation of such a proposal (expanded or otherwise) would entail. Though these include difficulties associated with disease burden metric, I argue that the most serious difficulties are associated with the problem of causal attribution. A basic idea underlying Pogge's proposal is that the disease burden reduction attributable to particular interventions can be determined. Theoretically speaking, in cases involving multiple interacting causal factors, there may be no fact of the matter regarding the extent to which disease burden reduction should be attributed to one intervention as opposed to another; and (even if workable practical solutions to this theoretical challenge can be met) the data requirements for implementation would be daunting. Blair equates the constructs of working memory (WM), executive function, and general fluid intelligence (gF). We argue that there is good reason not to equate these constructs. We view WM and gF as separable but highly related, and suggest that the mechanism behind the relationship is controlled attention – an ability that is dependent on normal functioning of the prefrontal cortex. The essay casts doubt upon the view that Albert was criticizing or was dependent upon Thomas Manlevelt's logico-philosophical views, and counter argues that it is in fact Manlevelt who knows and cites Albert's views in his recently edited Porphyrian Questions, rather than vice versa. First, it is argued that the brief comment Albert makes about ‘conjunct descent’ in treating the definition of merely confused supposition his Perutilis Logica does not conclusively (...) show that Albert is criticizing the logico-philosophical view of Thomas Manlevelt, as the notion of ‘conjunct descent’ is already present in the work of Heytesbury. Al-Farabi saw himself as inheriting from Aristotle the problem of limits to political responsibility for virtue. If the state possesses the authority to habituate citizens to virtue, what are the limits to that responsibility? Aristotle establishes two main limits: the family and the size of the state. Al-Farabi rejects both. Thomas Aquinas’s view of marriage as a sacrament, on the other hand, reinforces the Aristotelian position that the family is the most basic limit to public responsibility for virtue. In (...) fact, Aquinas expands the notion of subsidiarity beyond the family. Moreover, Aquinas and Aristotle agree that political life is not only limited from “below” by the family but also from “above.” Thus, in spite of Aquinas’ views on punishing heretics and apostates, it is not the case, as Leo Strauss’ claims, that Aquinas’ Christian faith led him to increase and exaggerate political responsibility for virtue. Thomas Hobbes's theory of the laws of nature covers only a subset of these rules, namely, those that “concern the doctrine of Civill Society”. There are many interpretations that attribute more ambitious aims to Hobbes, such as reconciling the claims of morality and interest, defending a version of divine command theory, showing that some aims are supremely rational, or using a theory of reciprocity to unite reason and morality. This chapter argues that Hobbes can accomplish his most important goals (...) with the minimalist theory. Hobbes describes the behavior of societies in the state of nature whose members support themselves by raiding other cities. Hobbes's moral theory makes the case for the state because it holds that social life governed by the laws of nature is available only within the state. In addition to supporting Hobbes's political theory, the minimalist theory presents an alternative to Aristotle's theory of justice. (shrink)

Thomas Aquinas consistently maintains that there are two kinds of beauty: bodily or sensible beauty and spiritual or intelligible beauty. Due to the lively debate over whether intelligible beauty is a transcendental for Thomas, discussions of his aesthetics have tended either to ignore his views on sensible beauty or to mention them only in passing. The present paper will therefore give a brief overview of Thomas’s thought on bodily beauty. The first section will discuss the objective aspects (...) of sensible beauty for Thomas, i.e., its definition and three conditions, while the second will present his views on its subjective aspects, i.e., how we experience it, why it pleases us, and its importance for human flourishing. The third and final section will examine how Thomas’s account of sensible beauty affects his views on the beauty of the glorified human body and of the universe as a whole after the Last Judgment. There is little interpretive consensus with regard to even the most basic concepts and claims. In Spinoza: Metaphysical Themes the diversity of interpretive perspective is vividly on display.All of the eleven essays in this collection are published here for the first time. They cover a broad range of topics and, taken together, they move us forward in our understanding of Spinoza's basic doctrines. Most of the essays are carefully argued discussions of clearly defined issues of interpretation. They address matters that are central to the system and central to our understanding of the system—monism, causation, individuation, conatus.The editors' Introduction claims that Jonathan Bennett's 1986 work set a new standard of Spinoza scholarship—a standard that the essays in this volume seek to measure up to. Most (not all) of these essays do indeed come close to Bennett's commendable level of argumentative clarity and rigor. And here, as in Bennett's work, the emphasis is mostly systematic and argumentative, not historical.The collection opens with a very good essay by Michael Della Rocca entitled "Spinoza's Substance Monism." This essay applies to the thorny issue of substance monism the same argumentative strategy that Della Rocca has elsewhere applied to monism regarding individual modes—i.e., to the claim that an extended mode and the idea of that mode are identical. The argument turns on the complete conceptual independence of the attributes, and Della Rocca makes a strong case for the centrality of that somewhat puzzling doctrine. John Carriero's contribution ("Monism in Spinoza") continues the focus on monism, but from a different perspective. Carriero asks, "Why does Spinoza hold that finite... bodies [End Page 560] are not substances?" (47). Rejecting two traditional responses he provides a plausible answer to this good question by focusing on an early exchange of letters between Spinoza and Oldenburg and upon Spinoza's rethinking of Descartes's conception of extension.One of the most interesting essays is Don Garrett's interpretive discussion of Spinoza's derivation of the conatus doctrine at Ethics3p4-3p6 ("Spinoza's Conatus Argument"). Commentators have identified various putative fallacies in the argument that Spinoza offers for this doctrine—chiefly fallacies of equivocation. Garrett develops an interesting and plausible notion of "inherence" that casts light on a number of central metaphysical relations and permits a defensible reading of the conatus argument. For the serious Spinoza scholar, this one essay is worth the price of the volume.Olli Koistinen's "Causation in Spinoza" considers Spinoza's solution to the difficulty of causal interaction between substances—a glaring problem in Descartes that provoked glaringly problematic solutions from Malebranche and Leibniz. Richard Manning's essay addresses a controversial point in Jonathan Bennett's interpretation. The issue is whether, in Spinoza's system, mental content can have causal significance—a point closely related to the important issue of teleological explanation of human behavior. Manning supports a kind of "thoughtful teleology," making a convincing case for the causal efficacy of mental content.On the whole the authors in this volume restrict their discussion of secondary literature to the works of fellow Anglophones. One finds occasional mention of Gueroult, but the Continental literature on Spinoza is mostly ignored. There are two notable exceptions to this rule. Steven Barbone ("What Counts as an Individual for Spinoza?") discusses the thorny issue of modal individuation in Spinoza's system, arguing against Matheron's 1969 claim that for Spinoza the state is an individual. Emphasizing the centrality of power, Barbone draws important (liberal) political conclusions from his analysis of individuation. Pp. x + 194. $35.00, Hardcover.The twofold goal of this book is clearly stated by its author: "to reconstitute by way of critical intellectual history a deeply nuanced, rhetorical understanding of emotion that prevailed (...) until the triumph of psychophysiology; second, to show by way of literary and philosophical example how this rhetorical perspective helps us read anew the emotional complex of modernity, whether early or late" (8). Gross' appreciation of the function of emotion emphasizes a phenomenological orientation that is inspired by Martin Heidegger's unpublished 1924 lecture course on Aristotle's Rhetoric. Gross recently co-edited with Ansgar Kemmann a book of original essays dedicated to a critical assessment of this lecture course (Gross and Kemmann 2006). In concluding her contribution to the book, the well-known Renaissance scholar Nancy S. Struever maintains that the course "remains, arguably, the best twentieth-century reading of Aristotle's Rhetoric" (Struever 2006: 127). Gross advances this reading with his creative and insightful assessment of his topic.This advance unfolds as Gross, abiding by phenomenology's well-known critique of the matter, takes issue with the reductive psychophysiology of emotion that Descartes first proposed and that informs latter-day sciences of the mind and the brain. Gross turns to the research program of the distinguished cognitive scientist Antonio Damasio as a way of arguing "how brain science of emotion goes awry when it blunders into social fact" (29). The reductionism of science, in other words, misses the forest for the trees. Admitting that Damasio is open to inquiries outside the boundaries of neurobiology, Gross nevertheless takes particular issue with Damasio's model for such a project: Edward O. Wilson's, Consilience: The Unity of Knowledge. Indeed, Wilson never gives rhetoric a nod when he acknowledges the worth of the humanities in his book.This slight, coming from Wilson, Damasio, and other scientists, fuels Gross's enthusiasm for turning to Aristotle's analysis of the pathe in book two of the Rhetoric. With Aristotle's discussion of "anger" in mind, for example, Gross emphasizes how we live in "a contoured world of emotional investments, where some people have significantly more liabilities than others" (3). [End Page 326]The point warrants elaboration: "The contours of our emotional world have been shaped by institutions such as slavery and poverty that simply afford some people greater emotional range than others, as they are shaped by publicity that has nothing to do with the inherent values of each human life and everything to do with technologies of social recognition and blindness" (4). Gross links this Aristotelian based social-psychological insight with such early modern philosophers, psychologists, and cultural critics as Thomas Hobbes, David Hume, William Perfect, and then with such contemporary intellectuals as Judith Butler. Gross' discussion of this linkage enables him to argue a key point in his overall project: the constitutive power of emotions depends not on how the social passions originate in a moral sense equally shared by all, but rather on the "uneven distribution" of these passions in our social and political lives.Gross makes much of how the rhetoric of this uneven distribution is at work in such particular cases as Aristotle's apathetic slave, Seneca's angry tyrant, Hobbes's resentful preacher, Sarah Fielding's humble hero, and Adam Smith's compassionate spectator. Gross's intellectual acumen shines as he weaves together these cases and expands on their implications for developing a rhetorical understanding of emotion. In this third volume of Speculations, a serial imprint created to explore post-continental philosophy and speculative realism, a wide range of topics are covered, from the philosophy of religion to psychoanalysis to the philosophy of science to gender studies, and in a wide variety of formats (articles, interviews, position pieces, translations, and review essays).

Ecological developmental biology (eco‐devo) explores the mechanistic relationships between the processes of individual development and environmental factors. Recent studies imply that some of these relationships have deep evolutionary origins, and may even pre‐date the divergences of the simplest extant animals, including cnidarians and sponges. Development of these early diverging metazoans is often sensitive to environmental factors, and these interactions occur in the context of conserved signaling pathways and mechanisms of tissue homeostasis whose detailed molecular logic remain elusive. Efficient methods for (...) transgenesis in cnidarians together with the ease of experimental manipulation in cnidarians and sponges make them ideal models for understanding causal relationships between environmental factors and developmental mechanisms. Controversy and activism have long been linked to the subject of primate research. Even in the midst of raging ethical debates surrounding fertility treatments, genetically modified foods and stem-cell research, there has been no reduction in the campaigns of activists worldwide. Plying their trade of intimidation aimed at ending biomedical experimentation in all animals, they have succeeded in creating an environment where research institutions, often painted as guilty until proven innocent, have avoided addressing the issue for fear of becoming targets. (...) One area of intense debate is the use of primates in stroke research. Despite the fact that stroke kills more people each year than AIDS and malaria, and less than 5% of patients are candidates for current therapies, there is significant opposition to primate stroke research. A balanced examination of the ethics of primate stroke research is thus of broad interest to all areas of biomedical research. (shrink)

Technological innovations such as next generation sequencing and DNA hybridisation enrichment have resulted in multi‐fold increases in both the quantity of ancient DNA sequence data and the time depth for DNA retrieval. To date, over 30 ancient genomes have been sequenced, moving from 0.7× coverage (mammoth) in 2008 to more than 50× coverage (Neanderthal) in 2014. Studies of rapid evolutionary changes, such as the evolution and spread of pathogens and the genetic responses of hosts, or the genetics of domestication and (...) climatic adaptation, are developing swiftly and the importance of palaeogenomics for investigating evolutionary processes during the last million years is likely to increase considerably. However, these new datasets require new methods of data processing and analysis, as well as conceptual changes in interpreting the results. In this review we highlight important areas of future technical and conceptual progress and discuss research topics in the rapidly growing field of palaeogenomics. -/- . (shrink)
